Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai ("the Service") by private individuals and business entities. These Terms apply both to publicly available features (e.g. the information page, waitlist) and to account-based features (if available).
1. General provisions and acceptance of the Terms
- By using the Service, you enter into an agreement with the Controller for the provision of electronic services and accept these Terms.
- If you do not accept the Terms, do not use the Service.
- If you use the Service on behalf of a company/organisation, you declare that you are authorised to act on its behalf and to bind it to these Terms.
- The Controller may provide the Service in a test (beta) version, with limitations in functionality and availability.
2. Definitions (summary)
- "Controller" - the entity operating the SmartTranslate.ai Service.
- "User" - a person using the Service.
- "Account" - the User's account in the Service, if registration/login functionality is available.
- "Content" - data entered or uploaded by the User to the Service, including text and documents for translation and the translation profile/settings.
- "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).
3. Description and scope of the service
- The Service enables the translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
- AI-generated results may contain errors, omissions, inaccuracies or unsuitable wording and may require human review.
- The Service is not a sworn translation service or legal, medical, financial or other specialist advice.
- The Controller may introduce, modify or withdraw Service features (including plans, limits and supported formats) in accordance with the rules described in the section on changes to the Terms.
4. Account, login and security
- Account creation and login may be carried out using an external authentication provider (Clerk).
- Access to login may be temporarily restricted (e.g. only for a selected group of users).
- The User is responsible for keeping login details confidential and for actions performed through their Account.
- If unauthorised access to the Account is suspected, the User should notify the Controller immediately.
5. User content and rights
- The User retains all rights to their Content. The Controller does not acquire ownership rights to the User's Content.
- The User grants the Controller a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making the results available to the User (e.g. the translated file).
- The User declares that they have the rights and legal basis to provide the Content to the Service (including personal data of third parties, if such data appears in the Content) and that the Content does not infringe the law or the rights of third parties.
- The User is responsible for how the translation results are used and for ensuring their compliance with the law and industry requirements.
6. Permitted use and prohibitions
- The Service may be used only in accordance with the law and with respect for the rights of third parties.
- It is prohibited to submit unlawful Content that infringes copyright, personal rights, legally protected secrets or other third-party rights.
- It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), or to bypass Service security measures.
- It is prohibited to use the Service excessively, automatically or disruptively in a way that may affect its stability (e.g. scripts, bots) without the Controller's prior consent.
- The Controller may use security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.
7. Plans, limits, fees and billing (if applicable)
- The Service may offer different Plans (including free and paid ones) with different limits (e.g. character limits per period, available file formats, translation history retention period).
- The current description of the Plans and prices is available in the Pricing section of the Service. In the event of any discrepancy between the Pricing section and promotional materials, the Pricing section and these Terms shall prevail.
- The Controller may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
- If the laws applicable to the User provide for specific consumer rights (e.g. the right of withdrawal), the Controller will respect them to the extent required by law.
8. Privacy and data
- The rules for processing personal data are described in the Privacy Policy, and the cookie rules are described in the Cookie Policy (available in the Service).
- By using the Service, you acknowledge that Content may contain personal or confidential data - before submitting it, make sure you have the right and legal basis to do so.
- The Controller may use technical data (e.g. IP address, user agent) for security and abuse prevention, in accordance with the Privacy Policy.
9. Service availability and support
- The Controller makes reasonable efforts to ensure the Service operates properly, but does not guarantee uninterrupted availability or error-free operation.
- The Controller may carry out maintenance work, updates and technical interruptions.
- The scope of technical support may depend on the Plan. General contact: privacy@smarttranslate.ai.
10. Liability and exclusions
- To the fullest extent permitted by law, the Controller is not liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. lost profits), unless mandatory provisions of law provide otherwise.
- The User is responsible for verifying the results, especially in legal, medical, financial, security or other critical applications.
- The Controller does not guarantee that the results will be free from errors or that they will meet all the User's expectations.
11. Consumers (EU) - right of withdrawal and complaints (if applicable)
- If you are a consumer in the EU/EEA, you may have specific rights under consumer protection rules and rules on digital services and digital content.
- For digital services, if you consent to the service beginning before the withdrawal period ends and you are informed of the consequences, you may lose the right of withdrawal in respect of the service already provided - in accordance with the law.

12. Suspension and termination of use
- The Controller may suspend or restrict access to the Service if the User breaches the Terms, the law or the security of the Service, as well as in the event of suspected abuse.
- The User may stop using the Service at any time. If the option to delete the Account is available, the User may use it or contact the Controller.
13. Changes to the Terms
- The Controller may amend the Terms for valid reasons, such as changes in law, security, Service functionality, suppliers or billing rules.
- The current version of the Terms is published in the Service together with the date of the last update. Significant changes concerning Accounts or paid plans (if available) will be communicated appropriately.
14. Governing law and final provisions
- These Terms are governed by the law applicable at the Controller's registered office, subject to mandatory consumer protection provisions.
- Disputes shall be resolved by the courts having jurisdiction over the Controller's registered office, unless mandatory provisions provide otherwise.
- If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
