Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai (the "Service") by individuals and business entities. These Terms apply both to publicly available features (e.g. the information page, waitlist) and to features that require an account (if available).
1. General provisions and acceptance of the Terms
- By using the Service, you enter into an electronic services agreement with the Operator and accept these Terms.
- If you do not accept these Terms, do not use the Service.
- If you use the Service on behalf of a company/organisation, you represent that you are authorised to act on its behalf and to bind it to these Terms.
- The Operator may make the Service available in a test version (beta), with limited functionality and availability.
2. Definitions (summary)
- "Operator" - the entity that runs the SmartTranslate.ai Service.
- "User" - a person using the Service.
- "Account" - the User's account in the Service, if registration/login is made available.
- "Content" - data entered or sent by the User to the Service, including text and documents for translation, as well as translation profile/settings.
- "Pricing" / "Plan" - information about the available ways of using the Service, limits and charges, published in the Service (e.g. on the pricing page).
3. Service description and scope
- The Service enables the translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
- AI-generated results may contain errors, omissions, inaccuracies, or unsuitable wording and may require human review.
- The Service is not a sworn translation service or legal, medical, financial, or other specialist advice service.
- The Operator may introduce, modify, or withdraw Service features (including plans, limits, supported formats) in accordance with the rules described in the section on changes to the Terms.
4. Account, login, and security
- Account creation and login may be handled through a third-party authentication provider (Clerk).
- Access to login may be temporarily restricted (e.g. to a selected group of users only).
- The User is responsible for keeping login details confidential and for actions carried out through their Account.
- If unauthorised access to the Account is suspected, the User should notify the Operator immediately.
5. User Content and rights
- The User retains the rights to their Content. The Operator does not acquire ownership rights in the User's Content.
- The User grants the Operator a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage, and making the results available to the User (e.g. the translated file).
- The User represents that they have the rights and legal basis to submit the Content to the Service (including personal data of third parties, if present in the Content) and that the Content does not violate the law or third-party rights.
- The User is responsible for how the translation results are used and for ensuring they comply with the law and industry requirements.
6. Permitted use and restrictions
- The Service may be used only in compliance with the law and with respect for the rights of third parties.
- It is prohibited to submit unlawful Content that infringes copyright, personal rights, legally protected secrets, or other third-party rights.
- It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), as well as to bypass the Service's security measures.
- It is prohibited to use the Service excessively, automatically, or in a disruptive manner that may affect its stability (e.g. scripts, bots) without the Operator's prior consent.
- The Operator may use security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.
7. Plans, limits, charges, and billing (if applicable)
- The Service may offer different Plans (including free and paid ones) with different limits (e.g. character limits per period, available file formats, translation history retention period).
- The current description of Plans and prices is available in the Pricing section of the Service. If there is any discrepancy between the Pricing section and promotional materials, the Pricing section and these Terms shall prevail.
- The Operator may introduce payments, subscriptions, invoicing, or billing for business/Enterprise plans. Details (including taxes, invoices, cancellation terms) will be communicated in the Service or during the purchase process.
- If the laws applicable to the User provide specific consumer rights (e.g. the right of withdrawal), the Operator will respect them to the extent required by law.
8. Privacy and data
- We describe the rules for processing personal data in the Privacy Policy, and the rules for cookies in the Cookies Policy (both available in the Service).
- By using the Service, you acknowledge that the Content may contain personal or confidential data - before sending it, make sure you have the right and legal basis to do so.
- The Operator may use technical data (e.g. IP address, user agent) for security and abuse prevention purposes, in accordance with the Privacy Policy.
9. Service availability and support
- The Operator makes efforts to keep the Service working properly, but does not guarantee uninterrupted availability or error-free operation.
- The Operator may carry out maintenance, updates, and technical downtime.

10. Liability and disclaimers
- To the fullest extent permitted by law, the Operator is not liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. lost profits), unless mandatory law provides otherwise.
- The User is responsible for verifying the results, especially in legal, medical, financial, security, or other critical use cases.
- The Operator does not guarantee that the results will be free from errors or that they will meet all the User's expectations.
11. Consumers (EU) - right of withdrawal and complaints (if applicable)
- If you are a consumer in the EU/EEA, you may have specific rights under consumer protection laws and laws on digital services and digital content.
- For digital services, if you consent to the service beginning before the withdrawal period ends and you are informed of the consequences, you may lose the right of withdrawal for the part of the service that has been performed - in accordance with the law.

12. Suspension and termination of use
- The Operator may suspend or restrict access to the Service if the User violates the Terms, the law, or the Service's security, as well as in the event of suspected abuse.
- The User may stop using the Service at any time. If the account deletion feature is available, the User may use it or contact the Operator.
13. Changes to the Terms
- The Operator may change the Terms for important reasons, such as changes in the law, security, Service functionality, providers, or billing rules.
- The current version of the Terms is published in the Service together with the date of the last update. Significant changes relating to Accounts or paid plans (if available) will be communicated appropriately.
14. Governing law and final provisions
- These Terms are governed by the law applicable at the Operator's registered office, subject to mandatory consumer protection rules.
- Disputes shall be resolved by the courts having jurisdiction over the Operator's registered office, unless mandatory law provides otherwise.
- If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
