Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai ("the Service") by individuals and business entities. These Terms apply both to publicly available features (e.g. the informational website, waitlist) and to features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an electronic services agreement with the Operator and accept these Terms.
  • If you do not accept these Terms, do not use the Service.
  • If you use the Service on behalf of a company or organisation, you represent that you are authorised to act on its behalf and bind it to these Terms.
  • The Operator may provide the Service in a test (beta) version, with limited functionality and availability.

2. Definitions (summary)

  • "Operator" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - the User's account in the Service, if registration/login functionality is made available.
  • "Content" - data entered or uploaded by the User to the Service, including text and documents for translation as well as translation profile/settings.
  • "Pricing" / "Plan" - information about the available ways of using the Service, limits and fees, published in the Service (e.g. on the pricing page).

3. Description and scope of the service

  • The Service enables the translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, level of formality).
  • AI-generated results may contain errors, omissions, inaccuracies or unsuitable wording and may require human review.
  • The Service is not a sworn translation service or legal, medical, financial or other specialised advice.
  • The Operator may introduce, modify or withdraw Service features (including plans, limits and supported formats) in accordance with the rules described in the section on changes to these Terms.

4. Account, login and security

  • Account creation and login may be carried out using a third-party authentication provider (Clerk).
  • Access to login may be temporarily restricted (e.g. to a selected group of users only).
  • The User is responsible for keeping login details confidential and for actions taken under their Account.
  • If unauthorised access to the Account is suspected, the User should notify the Operator immediately.

5. User content and rights

  • The User retains rights to their Content. The Operator does not acquire ownership rights in the User's Content.
  • The User grants the Operator a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making results available to the User (e.g. a translated file).
  • The User represents that they have the rights and grounds to submit the Content to the Service (including any personal data of third parties, if present in the Content) and that the Content does not infringe any law or the rights of third parties.
  • The User is responsible for how the translation results are used and for ensuring their compliance with applicable law and industry requirements.

6. Permitted use and prohibited activities

  • The Service may be used only in accordance with the law and with respect for the rights of third parties.
  • It is prohibited to submit unlawful Content that infringes copyright, personal rights, legally protected secrets or other third-party rights.
  • It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing) or to bypass Service security measures.
  • It is prohibited to use the Service excessively, automatically or disruptively in a way that may affect its stability (e.g. scripts, bots) without the Operator's prior consent.
  • The Operator may apply security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid) with different limits (e.g. character limits per period, available file formats, retention period for translation history).
  • The current description of Plans and prices is available in the Pricing section of the Service. If there is any discrepancy between the Pricing section and promotional materials, the Pricing section and these Terms will prevail.
  • The Operator may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
  • If the laws applicable to the User provide for specific consumer rights (e.g. the right to cancel), the Operator will respect them to the extent required by law.

8. Privacy and data

  • We describe how personal data is processed in the Privacy Policy, and how cookies are used in the Cookie Policy (both available in the Service).
  • By using the Service, you acknowledge that Content may include personal or confidential data - before uploading it, make sure you are entitled to do so and have a proper legal basis.
  • The Operator may use technical data (e.g. IP address, user agent) for security and abuse prevention, in accordance with the Privacy Policy.

9. Service availability and support

  • The Operator makes reasonable efforts to keep the Service working properly, but does not guarantee uninterrupted availability or error-free operation.
  • The Operator may carry out maintenance work, updates and technical interruptions.
  • The scope of technical support may depend on the Plan. General enquiries: privacy@smarttranslate.ai.

10. Liability and disclaimers

  • To the fullest extent permitted by law, the Operator is not liable for decisions made on the basis of results obtained from the Service or for indirect losses (e.g. loss of profit), unless mandatory law provides otherwise.
  • The User is responsible for reviewing the results, particularly in legal, medical, financial, safety or other critical uses.
  • The Operator does not guarantee that the results will be free from errors or meet all of the User's expectations.

11. Consumers (EU) - right of cancellation and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may have specific rights under consumer protection and digital services/content laws.
  • For digital services, if you consent to performance beginning before the cancellation period ends and you are informed of the consequences, you may lose the right to cancel in respect of the service already performed - in accordance with the law.

12. Suspension and termination of use

  • The Operator may suspend or restrict access to the Service if the User breaches these Terms, the law or the security of the Service, as well as in the event of suspected abuse.
  • The User may stop using the Service at any time. If the account deletion function is available, the User may use it or contact the Operator.

13. Changes to the Terms

  • The Operator may amend these Terms for important reasons, such as changes in law, security, Service functionality, providers or billing rules.
  • The current version of the Terms is published in the Service together with the date of the last update. Material changes relating to Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms are governed by the law applicable at the Operator's registered office, subject to mandatory consumer protection rules.
  • Disputes shall be resolved by the courts having jurisdiction over the Operator's registered office, unless mandatory law provides otherwise.
  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
