Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai ("Service") by individuals and business entities. These Terms apply both to publicly available features (e.g. informational page, waitlist) and to features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an agreement with the Administrator for the provision of electronic services and accept these Terms.
  • If you do not accept the Terms, do not use the Service.
  • If you use the Service on behalf of a company/organisation, you represent that you are authorised to act on its behalf and bind it to these Terms.
  • The Administrator may make the Service available in a test (beta) version, with limited features and availability.

2. Definitions (summary)

  • "Administrator" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - the User account in the Service, if registration/login is made available.
  • "Content" - data entered or sent by the User to the Service, including text and documents for translation, as well as translation settings/profile.
  • "Pricing" / "Plan" - information about the available ways of using the Service, limits and fees, published in the Service (e.g. on the pricing page).

3. Description and scope of the service

  • The Service enables translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
  • AI-generated results may contain errors, abbreviations, inaccuracies or inappropriate wording and may require human review.
  • The Service does not constitute certified translation services or legal, medical, financial or other specialist advice.
  • The Administrator may introduce, modify or withdraw Service features (including plans, limits and supported formats) in accordance with the rules described in the section on changes to the Terms.

4. Account, login and security

  • Account creation and login may be handled using a third-party authentication provider (Clerk).
  • Access to login may be temporarily restricted (e.g. only for a selected group of users).
  • The User is responsible for keeping login details confidential and for actions taken through their Account.
  • If there is any suspicion of unauthorised access to the Account, the User should notify the Administrator immediately.

5. User Content and rights

  • The User retains rights to their Content. The Administrator does not acquire ownership rights to the User Content.
  • The User grants the Administrator a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making results available to the User (e.g. the translated file).
  • The User represents that they have the rights and grounds to provide the Content to the Service (including personal data of third parties, if such data is included in the Content) and that the Content does not infringe any law or the rights of third parties.
  • The User is responsible for how the translation results are used and for ensuring their compliance with applicable law and industry requirements.

6. Permitted use and prohibitions

  • The Service may only be used in accordance with the law and with due respect for the rights of third parties.
  • It is prohibited to submit Content that is illegal or that infringes copyright, personal rights, legally protected secrets or other rights of third parties.
  • It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), as well as to bypass Service safeguards.
  • It is prohibited to use the Service excessively, automatically or in a disruptive manner in a way that may affect its stability (e.g. scripts, bots) without the Administrator's prior consent.
  • The Administrator may use security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid) with varying limits (e.g. character limit per period, available file formats, translation history retention period).
  • The current description of Plans and prices is available in the Pricing section of the Service. In the event of any discrepancy between the Pricing section and promotional materials, the Pricing section and these Terms shall prevail.
  • The Administrator may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
  • If the laws applicable to the User provide for specific consumer rights (e.g. the right of withdrawal), the Administrator will respect them to the extent required by law.

8. Privacy and data

  • The rules for processing personal data are described in the Privacy Policy, and the rules for cookies are described in the Cookies Policy (available in the Service).
  • By using the Service, you acknowledge that the Content may contain personal or confidential data - before sending it, make sure you have the right and a valid basis to do so.
  • The Administrator may use technical data (e.g. IP address, user agent) for security and abuse prevention, in accordance with the Privacy Policy.

9. Service availability and support

  • The Administrator makes reasonable efforts to keep the Service working properly, but does not guarantee uninterrupted availability or error-free operation.
  • The Administrator may carry out maintenance, updates and technical interruptions.

10. Liability and disclaimers

  • To the fullest extent permitted by law, the Administrator shall not be liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. loss of profits), unless mandatory provisions of law provide otherwise.
  • The User is responsible for verifying the results, especially in legal, medical, financial, safety-related or other critical uses.
  • The Administrator does not guarantee that the results will be error-free or that they will meet all of the User's expectations.

11. Consumers (EU) - right of withdrawal and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may have specific rights under consumer protection laws and laws on digital services and digital content.
  • In the case of digital services, if you consent to performance beginning before the withdrawal period expires and you are informed of the consequences, you may lose the right of withdrawal in respect of the service already provided - in accordance with the law.
  • Complaints or reports regarding the Service may be sent to: privacy@smarttranslate.ai (describe the issue and provide contact details).

12. Suspension and termination of use

  • The Administrator may suspend or restrict access to the Service if the User violates the Terms, the law or the security of the Service, as well as in the event of suspected abuse.
  • The User may stop using the Service at any time. If the account deletion feature is available, the User may use it or contact the Administrator.

13. Changes to the Terms

  • The Administrator may change the Terms for important reasons, such as changes in law, security, Service functionality, providers or billing rules.
  • The current version of the Terms is published in the Service together with the date of the last update. Material changes relating to Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms shall be governed by the law applicable to the Administrator's registered office, subject to mandatory consumer protection provisions.
  • Disputes shall be resolved by the courts having jurisdiction over the Administrator's registered office, unless mandatory law provides otherwise.
  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
