Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai (the "Service") by individuals and businesses. These Terms apply both to publicly available features (e.g. the information page, waitlist) and to features that require an account (if available).
1. General provisions and acceptance of the Terms
- By using the Service, you enter into an electronic services agreement with the Administrator and accept these Terms.
- If you do not accept the Terms, do not use the Service.
- If you use the Service on behalf of a company/organisation, you confirm that you are authorised to act on its behalf and to bind it to these Terms.
- The Administrator may make the Service available in a test (beta) version, with feature and availability limitations.
2. Definitions (summary)
- "Administrator" - the entity operating the SmartTranslate.ai Service.
- "User" - a person using the Service.
- "Account" - the User's account in the Service, if the registration/login feature is made available.
- "Content" - data entered or uploaded by the User into the Service, including text and documents for translation, as well as translation settings/profile.
- "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).
3. Description and scope of the service
- The Service allows content translation and, depending on the Plan, document translation using artificial intelligence models and translation profile settings (e.g. industry, style, tone, formality).
- AI-generated results may contain errors, omissions, inconsistencies or inappropriate wording and may require human review.
- The Service is not a sworn translation service or legal, medical, financial or other professional advice.
- The Administrator may add, modify or withdraw Service features (including plans, limits and supported file formats) in line with the rules described in the section on changes to the Terms.
4. Account, login and security
- Account creation and login may be handled through a third-party authentication provider (Clerk).
- Access to login may be temporarily restricted (e.g. to a selected group of users only).
- The User is responsible for keeping login details confidential and for actions carried out through their Account.
- If unauthorised access to the Account is suspected, the User should notify the Administrator immediately.
5. User Content and rights
- The User retains all rights to their Content. The Administrator does not acquire ownership rights to the User's Content.
- The User grants the Administrator a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making results available to the User (e.g. a translated file).
- The User confirms that they have the rights and legal basis to submit Content to the Service (including personal data of third parties, if such data appears in the Content) and that the Content does not infringe any law or third-party rights.
- The User is responsible for how the translation results are used and for ensuring they comply with the law and industry requirements.
6. Permitted use and prohibitions
- The Service may be used only in accordance with the law and with respect for third-party rights.
- It is prohibited to submit unlawful Content that infringes copyright, personal rights, legally protected secrets or other third-party rights.
- It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing), as well as to bypass the Service's security protections.
- It is prohibited to use the Service excessively, automatically or in a disruptive way that may affect its stability (e.g. scripts, bots) without the Administrator's prior consent.
- The Administrator may use security and abuse-prevention mechanisms (e.g. limits, rate limiting) and may suspend access in the event of violations.
7. Plans, limits, fees and billing (if applicable)
- The Service may offer different Plans (including free and paid options) with different limits (e.g. character limit per period, available file formats, retention period for translation history).
- The current description of the Plans and pricing can be found in the Pricing section of the Service. If there is any discrepancy between the Pricing and promotional materials, the Pricing and these Terms shall prevail.
- The Administrator may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
- If the laws applicable to the User provide specific consumer rights (e.g. a right of withdrawal), the Administrator will respect them to the extent required by law.
8. Privacy and data
- We describe personal data processing rules in the Privacy Policy, and cookie rules in the Cookie Policy (available in the Service).
- By using the Service, you acknowledge that Content may contain personal or confidential data - before submitting it, make sure you have the right and a valid legal basis to do so.
- The Administrator may use technical data (e.g. IP address, user agent) for security and abuse prevention, in accordance with the Privacy Policy.
9. Service availability and support
- The Administrator makes every effort to keep the Service working properly, but does not guarantee uninterrupted availability or error-free operation.
- The Administrator may carry out maintenance work, updates and technical interruptions.

10. Liability and disclaimers
- To the fullest extent permitted by law, the Administrator is not liable for decisions made on the basis of results obtained from the Service or for indirect damages (e.g. lost profits), unless mandatory law provides otherwise.
- The User is responsible for verifying results, especially in legal, medical, financial, safety-related or other critical use cases.
- The Administrator does not guarantee that the results will be error-free or that they will meet all the User's expectations.
11. Consumers (EU) - right of withdrawal and complaints (if applicable)
- If you are a consumer in the EU/EEA, you may be entitled to specific rights under consumer protection and digital services/content laws.
- For digital services, if you consent to the service starting before the withdrawal period expires and you are informed of the consequences, you may lose the right of withdrawal for the part of the service already performed - in accordance with the law.
- Complaints or reports about the Service may be sent to: privacy@smarttranslate.ai (describe the issue and include your contact details).
12. Suspension and termination of use
- The Administrator may suspend or restrict access to the Service if the User breaches the Terms, the law or the Service's security, as well as in the event of suspected abuse.
- The User may stop using the Service at any time. If the account deletion feature is available, the User may use it or contact the Administrator.
13. Changes to the Terms
- The Administrator may amend the Terms for important reasons, such as changes in law, security, Service functionality, providers or billing rules.
- The current version of the Terms is published in the Service together with the last updated date. Material changes concerning Accounts or paid plans (if available) will be communicated appropriately.
14. Governing law and final provisions
- These Terms are governed by the law applicable to the Administrator's registered office, subject to mandatory consumer protection laws.
- Disputes shall be resolved by the courts having jurisdiction over the Administrator's registered office, unless mandatory law provides otherwise.
- If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
