Terms of Service

These Terms of Service set out the rules for using SmartTranslate.ai (the "Service") by individuals and businesses. These Terms apply both to publicly available features (e.g. the information page, waiting list) and to features that require an account (if available).

1. General provisions and acceptance of the Terms

  • By using the Service, you enter into an agreement with the Controller for the provision of electronic services and accept these Terms.
  • If you do not accept these Terms, do not use the Service.
  • If you use the Service on behalf of a company or organisation, you confirm that you are authorised to act on its behalf and to bind it to these Terms.
  • The Controller may offer the Service in a test (beta) version, with limited functionality and availability.

2. Definitions (summary)

  • "Controller" - the entity operating the SmartTranslate.ai Service.
  • "User" - a person using the Service.
  • "Account" - the User's account in the Service, if registration/login functionality is available.
  • "Content" - data entered or uploaded by the User to the Service, including text and documents for translation as well as translation settings/profile.
  • "Pricing" / "Plan" - information about the available ways to use the Service, limits and fees, published in the Service (e.g. on the pricing page).

3. Description and scope of the service

  • The Service enables translation of content and, depending on the Plan, documents using artificial intelligence models and translation profile settings (e.g. industry, style, tone, level of formality).
  • AI-generated results may contain errors, omissions, inaccuracies or inappropriate wording and may require human review.
  • The Service does not constitute a certified translation service or legal, medical, financial or other professional advice.
  • The Controller may introduce, modify or withdraw Service features (including plans, limits and supported formats) in accordance with the rules described in the section on changes to these Terms.

4. Account, login and security

  • Account creation and login may be carried out using an external authentication provider (Clerk).
  • Access to login may be temporarily restricted (e.g. to a selected group of users only).
  • The User is responsible for keeping login details confidential and for actions carried out through their Account.
  • If unauthorised access to the Account is suspected, the User should notify the Controller immediately.

5. User Content and rights

  • The User retains all rights to their Content. The Controller does not acquire ownership rights to the User's Content.
  • The User grants the Controller a non-exclusive licence necessary to provide the service, including processing, analysis, transformation, translation, technical storage and making the results available to the User (e.g. the translated file).
  • The User confirms that they have the rights and legal basis to submit the Content to the Service (including any personal data of third parties, if present in the Content) and that the Content does not infringe any law or third-party rights.
  • The User is responsible for how the translation results are used and for ensuring that they comply with applicable law and industry requirements.

6. Permitted use and prohibited conduct

  • The Service may only be used in accordance with the law and with due respect for third-party rights.
  • It is prohibited to submit Content that is unlawful or infringes copyright, personal rights, legally protected secrets or other third-party rights.
  • It is prohibited to use the Service to create or distribute harmful content (e.g. malware, phishing) or to bypass the Service's security measures.
  • It is prohibited to use the Service excessively, automatically or disruptively in a way that may affect its stability (e.g. scripts, bots) without the Controller's prior consent.
  • The Controller may use security and anti-abuse measures (e.g. limits, rate limiting) and may suspend access in the event of breaches.

7. Plans, limits, fees and billing (if applicable)

  • The Service may offer different Plans (including free and paid ones) with varying limits (e.g. character limit per period, available file formats, retention period for translation history).
  • The current description of the Plans and prices is available in the Pricing section of the Service. In the event of any discrepancy between the Pricing and promotional materials, the Pricing and the provisions of these Terms shall prevail.
  • The Controller may introduce payments, subscriptions, invoicing or billing for business/Enterprise plans. Details (including taxes, invoices and cancellation terms) will be communicated in the Service or during the purchase process.
  • If the law applicable to the User provides specific consumer rights (e.g. a right of withdrawal), the Controller will respect them to the extent required by law.

8. Privacy and data

  • We describe the rules for processing personal data in the Privacy Policy, and the rules for cookies in the Cookies Policy (available in the Service).
  • By using the Service, you acknowledge that Content may contain personal or confidential data - before submitting it, make sure that you have the right and legal basis to do so.
  • The Controller may use technical data (e.g. IP address, user agent) for security and abuse prevention purposes, in accordance with the Privacy Policy.

9. Service availability and support

  • The Controller makes every effort to ensure that the Service works properly, but does not guarantee uninterrupted availability or error-free operation.
  • The Controller may carry out maintenance, updates and technical downtime.
  • The scope of technical support may depend on the Plan. General enquiries: privacy@smarttranslate.ai.

10. Liability and disclaimers

  • To the fullest extent permitted by law, the Controller accepts no liability for decisions made on the basis of results obtained from the Service or for indirect losses (e.g. loss of profit), unless mandatory law provides otherwise.
  • The User is responsible for checking the results, particularly in legal, medical, financial, safety-related or other critical uses.
  • The Controller does not guarantee that the results will be free from errors or that they will meet all of the User's expectations.

11. Consumers (EU) - right of withdrawal and complaints (if applicable)

  • If you are a consumer in the EU/EEA, you may have specific rights under consumer protection and digital services/content laws.
  • In the case of digital services, if you consent to performance starting before the withdrawal period ends and are informed of the consequences, you may lose the right of withdrawal in relation to the service already provided - in accordance with the law.
  • You can send complaints or reports concerning the Service to: privacy@smarttranslate.ai (please describe the issue and provide contact details).

12. Suspension and termination of use

  • The Controller may suspend or restrict access to the Service if the User breaches these Terms, the law or the Service's security, as well as in the event of suspected abuse.
  • The User may stop using the Service at any time. If the account deletion feature is available, the User may use it or contact the Controller.

13. Changes to the Terms

  • The Controller may amend these Terms for important reasons, such as changes in the law, security, Service functionality, providers or billing rules.
  • The current version of the Terms is published in the Service together with the date of the latest update. Significant changes affecting Accounts or paid plans (if available) will be communicated appropriately.

14. Governing law and final provisions

  • These Terms are governed by the law applicable at the Controller's registered office, subject to mandatory consumer protection laws.
  • Disputes shall be settled by the courts having jurisdiction over the Controller's registered office, unless mandatory provisions provide otherwise.
  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
